Terms & conditions of sale

These terms and conditions of sale govern any order placed on the website thesimpower.be. Please read them carefully before making a purchase.
1. Purpose
These terms and conditions of sale (the "T&Cs") govern the online sale, on the website thesimpower.be, of gift cards, event tickets and contest or raffle participation tickets. Any order placed on the site implies full acceptance of these T&Cs.

3. Products, services and prices
The products and services offered are described on the corresponding pages of the site. Prices are shown in euros (EUR), all taxes included (incl. VAT). The Sim Power reserves the right to change its prices at any time; products are billed on the basis of the rates in force at the time the order is confirmed.
Product images and descriptions are provided for information purposes and do not contractually bind the seller beyond the essential characteristics of the product.
4. Ordering process
Orders are placed online: product selection, entry of the required information, then confirmation and payment. The sale is deemed final once payment is confirmed. A confirmation e-mail summarising the order is sent to the address provided by the customer.
5. Secure payment
Payments are securely processed by our payment provider Stripe (Stripe Payments Europe, Ltd.). Bank details are transmitted in encrypted form and are never stored on our servers. The amount is charged when the order is confirmed.
6. Delivery of digital products
Gift cards, event tickets and contest tickets are digital products. They are delivered electronically (by e-mail, usually as a PDF file with a code) to the address provided at the time of the order, in principle immediately after payment is confirmed. It is the customer's responsibility to check the accuracy of their e-mail address and, where applicable, to check their spam folder.
7. Right of withdrawal and its exceptions
In accordance with the Belgian Code of Economic Law (transposing Directive 2011/83/EU), consumers are in principle entitled to a period of fourteen (14) days to withdraw from a distance purchase, without having to give a reason.
However, this right of withdrawal does not apply, in particular, in the following cases:
- leisure services provided on a specific date or period (dated event tickets, bookings of fixed-date sessions);
- the supply of digital content or a fully performed service, where performance has begun with your express consent and acknowledgement of the loss of the right of withdrawal;
- participation in a contest or raffle, once the entry has been registered.
For an unused gift card, you may contact us so that we can review your request within the applicable legal framework.
8. Validity of gift cards
Unless otherwise stated at the time of purchase, gift cards are valid for the period indicated on the voucher or in the confirmation e-mail. A gift card cannot be exchanged for cash or refunded. It must be presented (code or PDF) when used in our centres.
9. Cancellation and refund
Apart from the cases excluding the right of withdrawal referred to in article 7, any cancellation or refund request must be sent to info@thesimpower.com. If an event is cancelled by The Sim Power, the customer will be offered a postponement or a refund of the amount paid. Any refunds are made using the payment method used for the order.
10. Liability
The Sim Power cannot be held liable for damage resulting from misuse of the products, an input error by the customer (in particular of the e-mail address) or force majeure. In any event, the seller's liability cannot exceed the amount of the order concerned.
11. Personal data
Personal data collected in connection with an order is processed in accordance with the General Data Protection Regulation (GDPR).
12. Applicable law and disputes
These T&Cs are governed by Belgian law. In the event of a dispute, the customer is invited to first contact The Sim Power in order to seek an amicable solution.
Failing agreement, the consumer may use, free of charge, the Consumer Mediation Service (Belgium) or the European online dispute resolution platform (ODR):
